General Terms and Conditions
of Tourismus+Congress GmbH Frankfurt am Main
The Frankfurt Card offers cardholders the opportunity to use the services of the partners of the Frankfurt Tourismus+Congress Board (TCF) as described in the Frankfurt Card brochure.
Holders of the Frankfurt Card are entitled to use the local public transport of the Rhein-Main-Verkehrsverbund (RMV) in zones 50 (city area Frankfurt am Main) and 5090 (Frankfurt Airport). Excluded are long-distance trains (IC, ICE). Use of 1st class only with supplement. The one-day ticket is valid on the day inscribed until the end of operating hours, the two-day card is valid on the day inscribed and the following day until the end of operating hours (5 o’clock in the morning). The Conditions of Travel and current ticket prices of the Rhine-Main Transport Association (RMV) apply. Further information on Frankfurt's public transport system is available at www.rmv.de.
After booking, you will receive a confirmation email with a link to download your ticket. The ticket can be used digitally.
The Frankfurt Card is only valid with a date and name entry. Both entries (the date and names of all joint travellers) must be made at the time of purchase and cannot be changed afterwards.
Unused Frankfurt Cards will not be returned.
Note on group tickets:
Group tickets are valid for a maximum of 5 persons. Due to the system, only one card is issued per group. Depending on the number of persons, the corresponding participant names are issued, the remaining fields are automatically provided with the letter X five times for the first name and surname (XXXXX, XXXXX). It is not possible to change the number of persons or add participant names afterwards. In order to enjoy all the benefits of the Frankfurt Card, the group must remain together.
It is also possible to get the Frankfurt Card in credit card format as a hardcover version in our points of sale.
In this case, too, the Frankfurt Card is only valid with a date and name entry. These entries can also not be changed afterwards.
On the front of the card, the sales staff enters the date of use, in the case of the two-day ticket the first day of use, with a ballpoint pen.
On the back of the card, the names of all travelers must be entered by the customers themselves. Here, too, a ballpoint pen must be used. Only one card per group (max. 5 persons) will be issued. The group ticket is always designed for a maximum of 5 persons. If there are fewer travelers in the group, the remaining lines must be validated either with a dash ( ― ) or five times with the letter X (XXXXX). Even in the case of the hardcover version, the group must remain together in order to be able to take advantage of all the benefits of the Frankfurt Card.
Unused Frankfurt Cards will not be taken back, even as a hardcover version.
No additional discounts may be applied to already existing price reductions (e.g., for children). The Conditions of Use of our respective partner companies apply to all other services provided. Please note in particular the opening hours of participating museums and other establishments. The TCF does not assume liability or guarantee for the price reductions and general services offered by its partner companies. The TCF and its partner companies reserve the right to confiscate the Frankfurt Cards of individuals guilty of card misuse. In such cases, the individuals involved shall have no claim of compensation. Furthermore, we regret that no reissue of lost cards is possible.
The place of jurisdiction is Frankfurt am Main.

A. Conditions of Use for the Film and Photo Archives of the Frankfurt Tourist+Congress Board
The Frankfurt Tourist+Congress Board is happy to offer third parties the use of its film and photo material for purposes that serve to promote the tourist destination of Frankfurt am Main. This service is free of charge.
The Conditions of Use are based on the binding agreements arranged with the individual photographers and film-makers and shall be accepted as legal and binding for all matters pertaining to the publication/use of the film and image material offered herein.
Films and images are available as downloads at www.visitfrankfurt.travel. Users acknowledge the Conditions of Use with publication/use of a film, film sequence or one or more images.
The film and image material remains the property of the Frankfurt Tourist+Congress Board. The Frankfurt Tourist+Congress Board is happy to provide the usage rights free of charge, provided that the use of the films and images in question serves the promotion (advertising, PR etc.) of the tourist destination of Frankfurt am Main and adheres to the preconditions stipulated in Section B of this document. Further, with the costfree use of the films and images provided, users acknowledge and accept the copyright regulations stipulated within this document.
Copyright laws obligate users to indicate the copyright in the following manner: #visitfrankfurt, name of the photographer” (as well as names of other parties holding rights to the film or image in question, provided that such reference is required).
The Frankfurt Tourist+Congress Board and all other copyright owners are to be mentioned according to the following sample:

Reference shall preferably be made in close proximity to the film or image in question or within a separate photo index, including the respective page number. Should the user fail to provide such reference, the Frankfurt Tourist+Congress Board reserves the right to charge the user a fee of € 500,00 for every individual case, provided that the user is unable to prove that no or lesser damage has occurred. Users of film material are obliged to make the best effort to name the Frankfurt Tourist+Congress Board as source of any film published.
Users shall provide the Frankfurt Tourist+Congress Board (Film and Photo Archives) with a sample copy of the publication or an appropriate link to the material in question without request or delay.
The usage rights granted with the loan of film and image material are valid for single use only. Repetition and/or extension of the usage rights is only permissible upon prior approval of the Frankfurt Tourist+Congress Board.
Duplicating the cost-free film and image material for purposes of proprietary archiving or the electronic or digital storage of film and image data for archiving purposes (e.g. image databases) is strictly prohibited. Digitalised variations of material on loan shall be deleted in full after use. The further transfer and/or circulation of film and image material to third parties is only permissible for purposes of reproduction. Once again, the material must be deleted in full after use.
B. Free usage of film and image material is available for:
1. Design and development of tourist-oriented offers and other promotional publications pertaining to Frankfurt am Main as produced by foreign and domestic tour operators, travel agencies, air carriers, rail and coach services, cruise lines, hotels, trade show, congress and conference organisations, incoming agencies and similar businesses.
2. Design and conception of written contributions pertaining to Frankfurt am Main as published or shown on the Internet, TV, in newspapers, magazines and brochures as well as travel guides (basic principle: text, film and image must be of an informative, tourism-oriented and – in the broadest sense – promotional character).
3. Promotional support of conferences, congresses, trade shows and exhibitions in Frankfurt am Main. This also includes advertising measures promoting cultural institutions and associated events in Frankfurt am Main (e.g. art exhibitions, theatre, concert and sporting events etc.) as well as traditional and seasonal activities held annually in Frankfurt am Main (e.g. Museum Embankment Festival, Christmas Market etc.).
4. Promotional support by business enterprises, clubs, associations and private individuals outside of the tourist industry offered in the form of corporate and product advertising for the purpose of sales and image promotion, provided that the film and image material is also used to promote the overall image of the tourist destination of Frankfurt am Main (e.g., portrayal of Frankfurt am Main in image brochures or depiction of Frankfurt am Main in product brochures etc.).
C. Exclusions from cost-free use:
1. Any use of film and image material not expressly specified in Section B, especially those in which the film or image in question serves as the basis for realising business profits. Examples hereof include postcards, calendars, picture-books, posters, bills (with the exception of tourism-oriented billboards) and similar objects.
2. Any use of film and image material as promotional support for product or service presentations outside of the tourism industry, to the extent of film and image material being used for sales promotion purposes (e.g., as background motif for product presentations etc.).
D. Further notes
Prohibition of distortion and falsification
The distortion, falsification transformation or transmutation of a copyrighted item by means of reproduction, copying, photocomposing or other alteration by digital means is strictly prohibited. Exceptions require prior approval in writing by the Frankfurt Tourist+Congress Board as well as the respective title-holder, i.e., photographer.
Compliance with the press code
Users are obligated to acknowledge and adhere to the basic principles of the German Press Council (press code). Furthermore, users are responsible for all accompanying text including captions. The Frankfurt Tourist+Congress Board assumes no liability for breaches of general personal rights or copyright infringements caused by the unauthorised, immoral and unintended use of film or image material on loan. The same applies for any derogatory portrayal of individuals depicted on the films or images on loan. The user is solely liable for damages caused to possible third parties due to infringement of such rights. Moreover, in such cases, users are obligated to release the Frankfurt Tourist+Congress Board from any possible third-party claims and to compensate for any possible legal costs incurred. The use of film and image material for immoral, violence-glorifying, pornographic, unlawful or other unconstitutional purposes is expressly prohibited.
Liability for film and image material on loan
The Frankfurt Tourist+Congress Board assumes no liability for claims for compensation resulting from the use of film and image material on loan. The user assumes full responsibility in all cases, including those resulting from the copyright of proprietary image material. The Frankfurt Tourist+Congress Board also assumes no liability for claims resulting from infringements on trademarks.
Extended protection of copyright
Users taking advantage of our cost-free film and image material are granted the usage rights of the films and image(s) in question only. The copyright remains with the photographer at all times. This applies in particular to master images and films, which – due to content particularities – are subject to further copyright protection (e.g., works from the fields of fine and visual arts etc.). Here, users are obligated to recognise further copyrights and secure permissions for publication (for collections etc.).
Other
The Frankfurt Tourist+Congress Board is entitled to demand the destruction all printed or downloaded content should any infringement against one or more of the aforementioned items occur. Furthermore, the Frankfurt Tourist+Congress and third-party rights holders reserve the right to make claims of compensation wherever and whenever legally applicable.
Files are downloaded at the user’s own risk. The Frankfurt Tourist+Congress Board is not liable for damages that occur as a result of the download, transfer or use of files downloaded from its download area, insofar as this is legally permissible. Subject to the (applicable) law any liability for damages caused by computer viruses shall be excluded.
If not previously specified otherwise, the use of film and image material on loan is subject to the provisions of the German Copyright Act. German law also applies to deliveries from abroad. The place of jurisdiction and performance is Frankfurt am Main, regardless of the place of origin.
Should any individual provision stipulated in these Conditions of Use be or become illegal or invalid, all other provisions shall remain fully valid. A different provision shall apply ipso jure that most closely corresponds to the sense and intent of the original illegal/invalid clause, to the extent that this is legally permissible.
Place of jurisdiction and performance is Frankfurt am Main, provided that the user is a businessperson.

The RheinMainCard offers cardholders the opportunity to use the services of the partners of the NetzwerkTourismus FrankfurtRheinMain c/o Frankfurt Tourist+Congress Board (TCF) as described in the RheinMainCard brochure.
Holders of the RheinMainCard are entitled to unlimited use of the local public transport of the entire Rhein-Main-Verkehrsverbund (RMV). Excluded are long-distance trains (IC, ICE). Use of 1st class only with supplement. The two-day ticket is valid on two consecutive days from the inscribed date until the end of operating hours of the second day (5 o'clock in the morning). The Conditions of Travel and current ticket prices of the Rhine-Main Transport Association (RMV) apply. Further information on Frankfurt's public transport system is available at www.rmv.de.
With the print@home version of the RheinMainCard, it is possible to receive the invoice and the valid card to print out directly by e-mail after ordering.
The RheinMainCard is only valid with a date and name entry. Both entries (the date and names of all persons travelling together) must be made at the time of purchase and cannot be changed afterwards.
Unused RheinMainCards will not be taken back.

RheinMainCard holders must assert claims for non-fulfilment or poor performance directly with the respective partner.

General business conditions of accommodation services / room reservation
The Frankfurt Tourist+Congress Board (TCF) is merely acting as technical agent and is not a partner in the contract of accommodation. Contract partner is the corresponding provider (e.g. hotel, guest house).
The TCF provides booking services in the name and to the account of the participating providers and is therefore not operator under the terms of § 651 a, Paragraph 1 GBG (Federal Code).
Rights and obligations arising from the accommodation contract
The accommodation contract becomes effective upon reservation and acceptance of the room, or, should acceptance be no longer possible for reasons of urgency, upon provision of the room.
The conclusion of an accommodation contract obliges the contract partners to fulfilment of the contract regardless of its duration.
Upon non-availability of the room the accommodation provider (hotel owner) is obliged to make compensation to the guest.
On non-punctual cancellation or non-occupancy respectively non-utilisation of the contract performance the guest is obliged to pay the agreed or customary price minus outlays saved by the hotel.
The hotel owner is required in trust and good faith to re-allocate were possible rooms not occupied.
Liability
The TCF is liable for gross negligence and intent. Excluded is liability for handling errors, technical faults or shortfalls occurring subsequent to the point of contract travel agency, respectively tour operator/provider.
The TCF is not liable for disruptions due to force majeur, strikes or transmission failures in the scope of telecommunication.
The TCF is not liable for mal-performance non-performance or other infringements of the contract by the hotel/guest house owner or his/her vicarious agents, insofar as legally permissible.
Place of legal jurisdiction is the place of fulfilment exclusively.
To be strictly observed
Prior to commencement of the trip the reservation documents are to be checked for their adherence to the booking request given for processing the TCF. Any obvious deviation must be reported immediately to the TCF.
Claims on the TCF expire by limitation of one year following contractual begin of travel. Claims on the provider are to be asserted against the same.
Should any stipulation of these conditions of reservation be ineffective, the legal effectiveness of the remaining stipulations is thereby unaffected.
All data is valid on going to press. No liability can be accepted for correctness or completeness. The sequence of the hotels/guest houses is not an order of precedence.
1. Conclusion of Travel Contract
a) The trip contract must be concluded in writing. All sub-, ancillary agreements and special wishes must be put down in writing. Prior to conclusion of the contract we shall forward to you our unabridged General Travel Conditions. Upon conclusion of the contract or immediately thereafter we shall issue the complete trip confirmation. We are under no obligation hereto in the case of a short-term reservation made less than seven (7) working days prior to commencement of the trip. In such a case we draw attention to the obligations concerning the notice of defect and fixing of time limit prior to cancellation of a trip contract according to §§ 651 c ff BGB (Civil Code).
b) You are committed to the trip application for two weeks. During the time limit we shall confirm the arrangement. Short-term reservation two weeks and less prior to travel begin results in conclusion of the contract by the immediate confirmation.
c) Should our trip confirmation deviate from the trip application, the confirmation includes a new contract application to which we are bound for 20 days and which you may accept by returning the application within the period.
2. Payment
a) No down payment is due on contract conclusion unless our confirmation states otherwise, e.g. for certain functions and admission tickets (music performances etc.). Kindly note our confirmation.
b) The trip price is to be paid no later than three weeks prior to begin step-by-step upon issue of complete trip documents.
c) Upon contract conclusion within three weeks prior to trip begin you are obliged to immediate payment of the trip price upon issue of the complete trip documents.
d) We accept the following credit cards for payment: Mastercard and VISA. The trip price will be debited directly from your credit card account three weeks prior to the commencement of your trip.
e)The Frankfurt Tourist+Congress Board has taken out insurance against risk of insolvency with the Reisegarant GmbH (Touristic Insurance Service Association) according to § 651 K (1)-(3) BGB (Civil Code).
3. Performances
a) Our contractual performances based upon the binding performance description (prospectus/catalogue) as well as the trip documents, especially the trip applications and confirmation of the same.
b) We reserve the right for relevant, considerable and unforeseeable reasons to announce an amendment to prospectus details prior to conclusion of contract, of which we shall naturally inform you prior to booking.
c) Ancillary agreements, special agreements, agreed special wishes are to be included in the trip application and especially in the trip confirmation. Please refer to Clause 1.a) of these conditions.
d) All prices shown include the performances listed as well as the legal rate of VAT.
4. Changes in Performance and Price
a) Changes or variations in individual trip performances from the agreed content of the trip contract, which become necessary after contract conclusion and which are not effected by us against trust and good faith, are only then permitted when the changes or variations are not considerable and when they do not affect the overall form of the trip booked. Any eventual guarantee claims are unaffected insofar as the changed performances are subject to deficiencies. We are obliged to inform you immediately of any changes or variations in performances. If applicable we shall offer you a re-booking or cancellation at no cost.
b) We are entitled to demand a price increase of up to 5% four months following contract conclusion when it is evident and unforeseen that the prices of providers have increased. We are obliged to immediately inform you of a subsequent change in the price of the arrangement or a considerable change in performance, at the latest, however, 21 days prior to the beginning of the trip. In case of price increases amounting to more than 5% or in case of a considerable change in an essential trip performance you are entitled to withdraw from the contract without charges or to demand a rebooking of an equivalent trip, if we are able to provide such an arrangement from our programme without surcharge. Your are required to assert such rights immediately following our notification of a price increase or change in performance of the arrangement, respectively.
5. Withdrawal and Rebooking by the Client
a) You may withdraw from the arrangement at any time prior to commencement of the trip. The receipt by us of the withdrawal declaration is decisive. We recommend the submission of a withdrawal in written form. Should you fail to begin the trip, we are entitled to demand compensation for the arrangements made and for our expenses. In assessing the compensation the usual costs saved and the possible further utilisation of the trip performances are to be taken into account. Under consideration of the following table based on the proximity of the withdrawal time to the contractually agreed begin of the trip we may levy the compensation claims as a lump-sum percentage of the costs of the arrangement.
b) The following cancellation charges apply:
Up to 30 days prior to commencement of the trip cancellation is possible without charge. Thereafter the following cancellation charges per registered participant may be levied:
- 29 - 15 days prior to commencement: 15% of the price of the trip
- 14 - 07 days prior to commencement: 30% of the price of the trip
- 06 - 01 day(s) prior to commencement: 50% of the price of the trip.
- Thereafter: 80% of the price of the trip.
You are at liberty to satisfactorily show that the amount of damage caused, if any, is not in excess of the lump-sum reimbursement claimed by us. Admission tickets purchased by ourselves for theatre, opera and/or other additional services cannot be returned and must be invoiced in full in any case. Kindly note separate information accompanying individual confirmations which supersedes the above stipulation. Upon discontinuation of a trip for reasons within the sphere of the participant we shall endeavour to achieve reimbursement of saved outlays from the providers. This does not apply when completely insignificant performances are concerned.
c) Trip cancellation costs insurance is not included in the price. For your own peace of mind we advise taking out such insurance.
6. Substitute Participants
a) Up to commencement of the trip the participant may be substituted by a third person insofar as he/she fulfils the requirements of the trip and if his/her substitute participation is not precluded by legislation or official decree.
b) The participant and the third party are liable as co-debtors for the trip price.
c) The participant and the third party are liable as co-debtors for additional costs incurred as a result of participation of the third party, regularly calculated and without further notice as a lump sum of EUR 15,-.
7. Cancellation and Withdrawal by the Organiser and Annulment of the Contract due to Extraordinary Circumstances
We are entitled to withdraw from the contract prior to commencement of the trip or cancel the contract after commencement of the trip in the following cases:
a) Without observance of a notice period when you interfere with the execution of the trip despite a warning from our side or when you infringe the contract to such an extent that immediate annulment is justified. If we cancel we retain the claim on the trip price. We account the value of performances saved as well as the benefits we derive from further use of the performances not utilised including amounts credited to us by the providers.
b) Should the trip be considerably hampered, endangered or affected by force majeure unforeseeable at time of contract conclusion, then both the organiser as well as the participant may cancel the contract. Should the contract be cancelled, the organiser may demand appropriate compensation for performances already provided or performances still to be provided to terminate the trip. In case of force majeure we are obliged to undertake all measures necessary as a consequence of contract annulment, with the exception of return transport.
8. Liability of the Trip Organiser
a) Within the scope of duty of care of a responsible business person we are liable for:
1. Painstaking preparation of the trip.
2. Careful selection and supervision of the providers.
3. The accuracy of the description of all trip performances contained in the catalogue insofar as we have not announced a change in prospectus information prior to contract conclusion according to Clause 3.
4. We are liable for the provision of the arranged travel services as previously agreed upon.
b) We are liable for any faults suffered by a representative charged with providing these services.
9. Restriction of Liability
a) Our contractual liability for damages, which are not bodily injuries, is restricted to the threefold trip price,
1. insofar as damage of the participant was not caused with intent or gross negligence or
2. insofar as we are responsible for damage incurred by a participant solely due to the negligence of a provider. In this connection we recommend taking out accident and baggage insurance.
b) Any damage compensation claim against ourselves is insofar restricted or ruled out if, due to international agreement or prevailing legislation covering services to be provided by a provider, claim for damage compensation against the provider may only be asserted under certain conditions or limitations or is excluded under certain conditions.
10. Guarantee
a) Redress
Should the trip not be provided as agreed in contract, you may demand redress. We can refuse redress when this involves disproportionate cost.
b) Reduction of trip price
For the duration of non-contractual provision of the trip you may demand the corresponding reduction in the trip price. The trip price is to be reduced in proportion to the value of the trip in ideal condition at time of sale to the actual value. The reduction does not apply if you negligently fail to notify of the deficiencies.
c) Cancellation of the contract
If a trip is considerably impaired due to a deficiency and we have failed to supply redress within an appropriate period, you may cancel the contract under the terms of legislation - in your own interest and for preservation of evidence expediently as written declaration. The same applies if as a result of a deficiency for an important and to us apparent reason you cannot be expected to undertake the trip. The setting of the deadline for redress is not required when redress is impossible or is refused by ourselves or when the immediate cancellation of the contract due to a special interest from your side is justified. You are liable to us for that part of the trip price pertaining to the performances availed of, insofar as these performances were of interest to you.
d) Damage compensation
Regardless of reduction or cancellation you may demand compensation for damages due to non-fulfilment, unless the deficiency of the trip is due to a circumstance beyond our control.
11. Obligation to Cooperate
In the case of occurring performance disturbances you are obliged to cooperate under the terms of legislation, to avoid or keep to a minimum eventual damages. Your are specifically obliged to notify of your complaints immediately. Should you negligently fail to report a deficiency the claim for reduction is not applicable.
12. Exclusion of Claims and Statutory Period
Claims for non-fulfilment or non-contractual provision of performances must be lodged with us in writing within one month following the contractually foreseen end of the trip. Claims may be lodged after expiry of this deadline if you were prevented without blame from adhering to the deadline. Your contractual claims expire after the statutory period of one year. The statutory period begins on the day on which the trip should have ended according to contract. Should you assert such claims, the statutory period is lifted until the day on which we reject the claims in writing. Claims resulting from unauthorised action expire within three years.
13. Passport, Visa and Health Regulations
a) We are responsible for informing nationals of a country in which the trip is offered about passport, visa and health regulations and any possible changes thereto before commencement of the trip. The information will be supplied promptly so that deadlines for receiving the necessary documents can be adhered to. For nationals of other countries the consulate concerned will provide information. b) You yourself are responsible for the observance of all regulations important for the execution of the trip. All drawbacks, especially the payment of cancellation costs, resulting from the non-observance of these regulations are your responsibility, except when said drawbacks result from negligent, erroneous or non-information from our side.
14. Court of Jurisdiction
Court of jurisdiction for registered traders who are not business persons as designated by § 4 HGB (Commercial Code) is Frankfurt am Main.
15. Ineffectiveness of Individual Stipulations
The ineffectiveness of individual stipulations of the trip contract does not result in the ineffectiveness of the entire contract.

1. General
Tourismus+Congress GmbH Frankfurt am Main ("TCF") sells tickets for touristic services through the online shop at www.visitfrankfurt.de (hereinafter the "Online Shop"). Tickets may also be ordered over the telephone and by E-Mail. TCF only acts as the operator of the respective touristic service if TCF is expressly named as such. Otherwise, the operator is the third party named as such.
By purchasing the ticket, contractual relations with regard to the customer's participation in the touristic service are established exclusively between the customer (the ticket holder) and the respective tour operator. These legal relationships are governed exclusively by the operator's own general terms and conditions.
- The "Frankfurt Card" is subject to TCF's Frankfurt Card terms of use and the RMV's [transport provider in the Rhine/Main area] terms and conditions of carriage. - The RheinMainCard is subject to TCF's RheinMainCard terms of use and the RMV's [transport provider in the Rhine/Main area] terms and conditions of carriage. - The city walking tours are subject to TCF's General Terms and Conditions for public tours.
Where TCF is not expressly named on the ticket as the operator of the the touristic services, TCF sells the tickets as an agent on behalf of the respective operator.
The following General Terms and Conditions of sale shall apply exclusively to all business dealings between TCF and Online Shop customers, particularly as regards the delivery of tickets. TCF does not accept any deviating terms and conditions of the customer unless TCF expressly acknowledges them in writing.

3. Formation of contract
a) The presentation of the touristic services in the Online Shop does not constitute a legally binding offer by TCF to customers. Instead, it provides customers with a non-binding option to order the relevant tickets from TCF.
b) By clicking on "Confirm chargeable booking" or rather according to § 312j Abs. 2 BGB labeled button, the customer makes a legally binding offer to TCF to enter into a purchase agreement in respect of the tickets in the customer's shopping cart. Similarly, where a customer orders tickets over the telephone or by E-Mail, they make a legally binding offer to enter into a purchase agreement in respect of the relevant tickets. Such a binding offer can only be made if the customer has already accepted these General Terms and Conditions of sale. Customers may review and change their order at any time prior to submitting their order.
c) TCF will accept the customer's offer either by sending an order confirmation or by sending e-tickets as of receipt of customer's order. A purchase agreement is formed by the acceptance oft the offer.
e) TCF will provide the customer with confirmation of the agreement on a durable medium (e.g. in an E-Mail) which reproduces the terms of the agreement. This shall occur within a reasonable time after the agreement is entered into, but not later than upon delivery of the goods.
4. Prices
All prices listed in the Online Shop and otherwise provided by TCF include VAT at the statutory rate.
5. Payment
Depending on the order method, payment may be made by credit card or by using PayPal.
a) Credit card payments
TCF will charge the relevant amount to the customer's credit card only upon sending the tickets. TCF has linked its payment system to a 3D secure authentication process. Therefore, when payments are made by credit card, an additional verification process established by the card-issuing bank is carried out. If you have any questions regarding the 3D secure system and the authentication process, please directly contact the bank that issued your card.
b) Payments via PayPal
TCF accepts payments via PayPal. PayPal payments are processed by PayPal (Europe) S.a.r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg.
When tickets are purchased using PayPal, they are sent to the customer without undue delay after PayPal has provided confirmation of the customer's payment. The payment is collected upon sending the tickets.
6. Shipement
E-tickets are sent with the order confirmation to the E-Mail address nominated by the customer.
7. Set-off
The customer may only claim set-off on the basis of counter-claims legally established or counter-claims acknowledged or not contested by TCF. Furthermore, the customer may only exercise a right of retention if and to the extent that its counter-claim is based on the same contractual relationship.
8. Warranty (information regarding liability for defects)
The statutory provisions on warranties apply with the exception of the limitation of number 9.
9. Limitation of Liability
TCF's liability is unlimited in cases if it commits any wilful or grossly negligent breach of duty. Similarly, TCF's liability is unlimited if it commits any wilful or grossly negligent act or omission causing fatal or bodily injury or injury to health. Where property damage or pecuniary loss is caused by TCF's ordinary negligence, TCF shall only be liable if it has breached duties which must necessarily be fulfilled in order for the agreement to be performed at all, and where the customer is especially entitled to rely on the fulfilment of such duties ("material contractual obligations"), however TCF's liability is limited to damage or loss that was reasonably foreseeable at the time of entering into the contract.
10. Rebooking/Cancellation
a) Frankfurt Card, RheinMainCard, city tours: Rebooking/cancellation of tickets is excluded.
b) TCF city walking tours: Free rebooking/cancellation up to 24 hours before the start of the tour.
Rebookings and cancellations that reach us outside of the service hours (these are Monday to Friday from 9:00 a.m. to 5:00 p.m. except on public holidays) will be carried out on the next working day at the latest. Decisive for the execution of a free cancellation/rebooking is the timely receipt of the message 24 hours before the start of the tour.
11. Missing right right of revocation/types of contract without an option to revoke
Private end customers (consumers within the meaning of section 13 of the German Civil Code (Bürgerliches Gesetzbuch, "BGB")) generally have a statutory right to revoke contracts entered into through the Online Shop. However, this right of revocation does not apply to the following types of contract:
- agreements to provide services involving non-residential accommodation, the carriage of goods, vehicle hire, the delivery of food and drink and agreements to provide other services in connection with leisure activities that stipulate a specific date or period for the provision of the services (section 312g (2) sentence 1 no. 9 BGB), as long as travel services within the meaning of section 651a BGB are not involved.
This means that customers have no right of revocation where TCF provides or mediates transport services or services involving leisure activities, specifically tickets for tourist events. Therefore, every customer order for tickets is binding immediately after the order is confirmed by TCF, and obliges the customer to accept and pay for the ordered tickets without the opportunity of revocation.
For contracts, that are not affected by the regulation of section 312 g (2) sentence 1 no. 9 BGB, the following applies:

Right of withdrawal
You have the right to withdraw this agreement within 14 days without specifying reasons.
The period to withdraw is 14 days from the date on which you or a third party nominated by you, but not the carrier,receives the travel confirmation..
In order to exercise your right of withdrawal, you must notify us (Tourismus+Congress GmbH Frankfurt am Main, Kaiserstraße 56, 60329 Frankfurt am Main, Germany; E-Mail: info@infofrankfurt.de; facsimile: +49 69 21 23 78 80) of your decision to revoke the agreement by means of an unequivocal statement (e.g. by letter sent by post, by fax or E-Mail). You may use the attached revocation form, which is, however, not obligatory.
To meet the withdrawal deadline, it is sufficient for you to send your notice of withdrawal before the period to withdraw has expired.
Consequences of withdrawal
If you withdraw this agreement, we shall refund all payments received from you without undue delay, but in any event not later than 14 days from the date on which we received your notice of revocation. We will carry out such refund using the same method of payment as the method you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees in connection with such refund.
The consumer must provide compensation for the services rendered up to the point of revocation. This only applies insofar as the consumer has expressly requested the entrepreneur to start the service before the end of the cancellation period.

12. Data privacy
All personal data collected from the customer will be treated as confidential. The collection, processing and use of personal data will be subject to the provisions of the German Federal Data Protection Act (Bundesdatenschutzgesetz) and the German Telemedia Act (Telemediengesetz). Personal data will only be collected if the customer has voluntarily provided such data to TCF during the ordering process. TCF uses data provided without the customer's specific consent solely in order to fulfil and process the order. Once the purchase agreement has been completed and the purchase price has been paid in full, the data is blocked from further use and deleted upon the expiry of the periods prescribed by tax and commercial law, unless the customer has expressly consented to its further use.

13. Governing law
The laws of the Federal Republic of Germany shall apply. The application of the UN Convention on Contracts for the International Sale of Goods (CISG) shall be excluded.
14. Ineffectiveness of individual provisions
The invalidity of individual provisions shall not result in the invalidity of the entire contract.
1. Scope of terms and conditions
- These standard terms and conditions of booking govern the business relationship between TCF and its customers. TCF's standard terms and conditions of booking shall apply even if TCF is aware of the customer's terms and conditions at the time of confirming the customer's booking. TCF shall not recognise conflicting, varying or additional terms and conditions of the customer unless it expressly agrees to them in writing.
2. What is covered by the terms and conditions
- a) TCF organises Guided Tours. For this purpose TCF books independent guides for the Guided Tours (City Walks and CityTours by Bus)
- b) The guides arranged by TCF can be booked for specific Guided Tours set by TCF in advance (e.g. "The imperial hall in the Römer (Kaisersaal)").
3. Conclusion of booking contract
- a) Specific bookings for Guided Tours with TCF must be made in writing or by e-mail. Bookings are deemed to be a binding declaration of intent on the part of the customer.
- b) No contract shall be formed with TCF until TCF has confirmed the booking with the customer in writing or by e-mail ("Booking Confirmation / Invoice").
- c) Similarly, any changes to a binding booking may only be made in writing or by e-mail.
- d) Where the customer is required to prepay for the tour (e.g. in the cases referred to in clause 5.c)e)), once the binding booking is made the customer will receive a form authorising TCF to check the customer's credit card details and to charge the relevant amount to the customer's credit card after confirming the booking. The customer must complete and sign this form and return it to TCF. TCF will only confirm the customer's booking and send a Booking Confirmation / Invoice after receiving the properly completed and signed form and checking the customer's credit card details.
- e) A cap on the number of participants per guide applies for certain Guided Tours. TCF will advise the customer of any such limitations in its specific quote. If the desired group size exceeds the cap on participants in any particular case, TCF will offer to book an additional guide for the customer; in such cases the group will be divided between the guides.
4. Price of admission; costs of the arranged guide
- a) Where admission fees are charged to enter certain places on a guided tour (e.g. the Goethe House) they must be paid separately by the customer
- b) The generally valid ticket prices in the institutions apply.
- c) Due to the possibility of unexpected waiting times or unforeseeable, short-term closures of certain establishments (e.g. the Goethe-House, St. Paul’s Church, Emperor’s Hall), the TCF is unable to guarantee that its tour guides will accompany participants on their tour of the respective establishments if the timeframe predetermined for the tour has already been exceeded.
- d) Travel costs for the guide may be incurred, particularly in the case of customised Guided Tours. These costs are not included in the guide's rates and will be charged additionally.
- e) In exceptional cases only, and only if expressly confirmed by TCF, the meeting and/or end point is outside Frankfurt.
5. Payment details
- a) The specific terms of payment are set out in the offer and the order confirmation / invoice.
- b) If the customer's billing address is within Germany:
- (1) the invoice total is payable after receipt of the Booking Confirmation / Invoice no later than three (3) weeks prior the tour date.
- (2) Bookings made less than three (3) weeks prior to the tour date require immediate payment of the invoice total.
- c) Customers whose billing address is outside Germany are required to prepay for tours upfront by credit card.
- d) Where the customer is required to prepay but their credit card is declined (e.g. because the customer provided incorrect credit card details or their credit limit is exceeded), TCF is entitled not only to refuse to provide its services, but also to rescind the contract.
- e) If the customer has prepaid by credit card and a refund is owed to the customer after the provision of TCF's services (e.g. if a guide is sick), the relevant amount will be refunded to the customer in the payment manner selected by the customer. If there are amounts still payable by the customer after the provision of TCF's services, the outstanding payments will be billed to the customer retrospectively and charged to the customer's nominated credit card accordingly.
6. Guides arranged by TCF
- a) TCF chooses the guide depending on the qualifications required for the Guided Tour. The customer has no right to require a specific guide.
- b) Even where a specific guide is named, TCF reserves the right to arrange another appropriate and suitably qualified substitute guide if the original guide is unavoidably incapacitated (for example due to ill health).
- c) Guides are not to be contacted before the appointed meeting time. The personal information of the arranged guide is subject to privacy and data protection provisions, and TCF does not disclose such information to third parties.
- d) Guides arranged by TCF have no obligation to supervise participants during Guided Tours. Groups of minors (e.g. school groups) must be accompanied by a sufficient number of supervising adults. If it is the guide's opinion after proper appraisal that there are not enough supervising adults, the guide may refuse to commence the Guided Tour or interrupt any Guided Tour that has already commenced. The group will then be deemed to have failed to show up.
- e) Guides arranged by TCF do not advance cash to tour groups to cover admission, meals and other incursions. Similarly, the arranged guides do not collect cash at the door to cover admission.
7. Services
- All details and the description of the Guided Tours in brochures and on the internet etc. are merely provided as a general indication of the services available. They do not constitute a guarantee of a certain way of running the Guided Tours. TCF is liable only for providing the services expressly stated in the Booking Confirmation/Invoice.
8. Changes to the service and price changes
- a) The agreed booking may be changed or varied as long as the changes or variations are reasonable for the customer having regard to TCF's interests. In particular, changes and variations shall be deemed reasonable if they are immaterial and do not have a significant negative impact on the overall configuration of the booked tour, or if they are the result of external circumstances outside TCF's control, e.g. blocked streets, museum closures, last-minute illness of the guide etc. TCF has an obligation to notify the customer of service changes or variations without undue delay. If applicable, TCF may offer the customer the opportunity to rebook at no extra charge. The customer is entitled to rescind the contract if the changes or variations are not reasonable for the customer having regard to TCF's interests.
- b) A tour group has no right to a tour extension or a price reduction if it fails to turn up on time. Any extension of Guided Tours is at the guide's discretion. If the tour is extended, the total work time of the guide to be paid for shall be the time spent by the guide waiting and the actual duration of the tour. The maximum time that a guide will wait is 45 minutes. If the tour group is delayed by more than 45 minutes, it will generally be deemed to have failed to show up (with costs being governed by clause 9.a)).
- c) A guide's work time commences and finishes in Frankfurt. If a guide starts or finishes the tour outside Frankfurt, the guide's work time shall be extended accordingly and any travel costs incurred and the additional work time will be charged.
9. Cancellation and rebooking by the customer; failure to show up
- a) Customers may cancel their booking free of charge by notifying TCF in writing or by e-mail at least fourteen (14) days prior to the date of the tour. After such time, a cancellation fee of 100% of the costs of the tour applies – in such a case the customer is required to pay the agreed price in full. Relevant for the purposes of determining the date of cancellation is the date on which TCF receives the written or e-mailed (at the e-mail address stated in the Booking Confirmation/ Invoice) notice of cancellation.
- b) The agreed price is also payable in full if a customer or a group fails to show up for a booked tour.
- c) In all cases, the customer is allowed to prove that TCF did not suffer any damage or suffered substantially less damage as a result of the cancellation or failure to show up. Notwithstanding the fixed amount referred to above, TCF reserves the right to demand higher compensation based on individual calculations.
- d) TCF reserves the right to apply more restrictive cancellation conditions during peak booking periods, trade fairs and for tours scheduled on public holidays. The relevant quote and Booking Confirmation / Invoice contain details of the modified cancellation period and the associated terms and conditions of cancellation.
- e) Depending on the work involved, administrative fees of up to € 30.00 may be charged for extensive re-bookings, changes and the cancellation of services that have already been booked and are the subject of a binding agreement (tour guides). Such matters are otherwise governed by the above terms and conditions of cancellation.
10. Limitation of liability
- For damage other than personal injury, we shall only be liable if the damage was caused by our intentional misconduct or gross negligence, or by a breach of material contractual obligations (major obligations). If TCF negligently breaches its major obligations, its liability shall be limited to such loss or damage which is reasonably foreseeable in connection with the contract. TCF's liability shall in any event be limited to three times the value of the offered services. This limitation of liability also applies to TCF's vicarious agents.
11. Choice of law and jurisdiction
- These terms and conditions are governed exclusively by German law, subject to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG). If the customer is a merchant, a legal entity under public law or a special fund under public law, or if it has no place of general jurisdiction in the Federal Republic of Germany, the place of exclusive (and international) jurisdiction for any and all disputes arising out of or in connection with TCF's business dealings with the customer shall be Frankfurt am Main.

1. Vouchers
a) The customer has the option of purchasing vouchers for services provided by Tourismus+Congress GmbH Frankfurt am Main "TCF".
2. Purchase of the Vouchers
The customer has the option to order vouchers from TCF. Orders are placed online or by telephone. The customer pays by credit card or PayPal during the booking process. TCF sends the booking confirmation/invoice with a download link for the voucher to the customer by e-mail.
3. Redeeming the Vouchers
a) The voucher beneficiary must provide the voucher code at the time of booking. The booking contract is concluded in accordance with the General Booking Conditions of the booked service.
b) The redemption of the voucher is not bound to the person designated in the voucher.
4. No Payout
The value of the voucher cannot be paid out.
5. Validity
The voucher can be redeemed within a period of three years to the end of the year. The period begins at the end of the year in which the voucher was issued.
6. Choice of Law and Place of Jurisdiction
German law shall apply exclusively to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG). If the customer is a merchant, a legal entity under public law or a special fund under public law or if he has no general place of jurisdiction in the Federal Republic of Germany, the exclusive - also international - place of jurisdiction for all disputes arising from the business relationship between TCF and the customer shall be Frankfurt am Main.
